This programme provides a full picture of German Contract Law and the all-important differences with the English Legal System. The course also outlines a history of the German Legal System.
German Civil Law is the foundation of private law rules in many civilian jurisdictions. It regularly features in international arbitration and has been extremely present in attempts at European civil law unification. A basic understanding of German Contract Law, in particular, will help prepare students for careers in academia, by exploring the fundamental foundations of German Contract Law from a comparative perspective, or in practice, in advising clients and cooperating with lawyers from civilian jurisdictions. This course will: provide an overview of the historical foundations of German Civil Law; explain how contracts are formed in Germany; consider the liability that arises pre-and post-contract and discuss the provisions which apply when a contract breaks down.
